This document contains the terms and conditions, terms of use and the privacy policy (together the “Terms”) that regulate your participation in the Euroleague Basketball Commentators Challenge, your access, browsing and use of the internet website https://commschallenge.euroleague.net  (the “Website”) as well how we collect and use your personal data.

 

TERMS AND CONDITIONS

 

This challenge is organized by Euroleague Ventures SA (the "Organizer"). By participating you agree to be bound by these Terms. The Organizer reserves the right to cancel or amend the challenge at any time and without notice and no liability shall attach to the Organizer as a result thereof.

 

Participation in this challenge is free. Any costs and/or expenses incurred or to be incurred by participants in relation to the challenge, if any, are the sole responsibility of the participant.

 

Participants under 18 years of age as of date of the entry are not permitted to participate. Any minor who uses false information to participate will not be eligible to claim any prize. Organizer reserves the right to ask winners to provide the prove of age. The challenge is not open to Organizer’s employees or anyone directly associated with the Organizer or the administration of the challenge.

 

A valid EuroLeague ID is required to participate. You can get yours here. The computer record of the upload of the video will be considered as being the formal application once the platform confirms a successful upload. Any application not adhering to the required format or requirements, incorrect applications or incomplete applications will be deemed invalid.

 

Participants hereby acknowledge and accept that all intellectual property rights pertaining to the commented play, are the property of the Organizer or licensed to the Organizer by third parties. Under no circumstances shall participation in the challenge imply any kind of waiver, transfer, licence or grant of the said rights, whether wholly or in part, unless expressly otherwise established. These present Terms do not grant Users any right to use, alter, exploit, reproduce, download, distribute or publicly broadcast the play for any other purposes than the participation in the challenge.

 

Organizer reserves the right to withdraw the prizes (or any part of it) if a winner breaches any of these Terms or if they are found to have acted in a dishonest or fraudulent manner.

 

CHALLENGE DISCLAIMERS

 

The Organizer cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any participant entering the challenge or as a result of accepting any prize. The Organizer is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer or mobile telephone related to or resulting from participation or downloading or uploading any materials in the challenge.

 

 

PARTICIPANT DECLARATION

 

Participant agrees to be bound by these Terms by uploading a video for the challenge. By participating in the challenge, the participant hereby warrants that all information submitted is true, current and complete.

 

Participant understands and accepts that participation in this challenge may imply the display of the video uploaded on the official platforms of Euroleague Basketball, including but not limited to website, Instagram, Twitter and Facebook.

 

Participants understand and accept that participation will imply, in case that his/her video qualifies for the final phase, the display on the official EuroLeague Instagram account (@euroleague) for a public voting (Instagram poll) to be conducted in order to select the winner of the challenge. Participant is solely responsible for his/her ELID profile pictures, video content and personal information (the “Submissions”) they submit and that the finalists will become visible on the Instagram account and Euroleague Basketball Media Partners websites and printed publications. Participant represents and warrants that: (i) they are free to enter into and are fully authorized to participate in the challenge; (ii) the Submissions they have entered are true and comply with the rules; (iii) the upload of the Submissions on the Website, or the use by the Organizer of the Submissions as permitted under these Terms shall not violate the privacy rights, image rights, copyrights, contract rights or any other rights of any person.

 

Participant grants to Organizer and any affiliates of Organizer (including but not limited to Euroleague Properties SA) and the Euroleague Basketball partners a worldwide, sub-licensable and royalty-free right and permission to use his/her image, voice, name, and likeness of his/her performance and accepts all media development of the performed commentator at Organizer’s sole and complete discretion in any forms and by any means, including but not limited to internet and social media clips and documentaries. Such use includes materials that include, but may not be limited to, printed materials such as record labels, marketing material, brochures, news releases and newsletters, videos and digital images such as those for use with the release of such performances to the public in any and all formats or on the Organizer’s websites and in any and all media, and incorporated by Organizer in any and all other media whatsoever provided that such production, exploitation and commercialization takes place in relation to the challenge.

 

The Participants grant to Organizer and the Euroleague Basketball partners the right to use the videos and all material received during the challenge for advertising, marketing and communication purposes without compensation to the participant, his or her successors or assigns, or any other entity.

 

Participant acknowledges that should any taxes or legal requirements be applicable to the prizes, these shall be its own responsibility.

 

These Terms have been drafted in English. The Participant acknowledges and agrees that he/she has read and understood these Terms and that are fully aware of the rights and obligations arising therefrom.

 

By participating in the challenge, the Participant agrees that no claim relating to losses or injuries or disappointment suffered by participating in the challenge or as a result of accepting any prize (including special, indirect and consequential losses) shall be asserted against the Organizer, its parent companies, sponsors, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the participation in the challenge and/or the use of any other prizes.

 

 

CHALLENGE RULES

 

When participating in the challenge, the participants are bound to play and accept that they must participate in the challenge in accordance with the Terms.

 

Participants need to record themselves on video pretending that they are commentators.

 

The video needs to be uploaded on the Website. Only one video to be submitted by each participant. A confirmation message will be provided by the platform to confirm that your video has been successfully uploaded.

 

The play to be commentated has been defined by the Organizer: Printezis shot 2012, which can be found here. Videos recording participant’s performance on any other play will not be eligible.

 

Videos need to be recorded in the English language and submitted in the following format and within the following timeframe:

 

Format: The video file cannot be larger than 300Mbs and must be saved and sent in one of these formats: .avi .wmv .mp4 .mov .m4v

Timeframe: From May 7th at 14:00 to May 11th at 00:00. Any videos uploaded after May 11th at 00:00 will not be valid, accepted or considered.

 

Videos shall in all cases respect the notes relating to intellectual property rights and other information that identifies the rights of EV or third parties that are attached to the video play. Videos shall be in accordance with moral rectitude, generally accepted good practice and public order. In particular, videos shall not: in any way breach any applicable local, national or international law or regulation, in any way be unlawful or fraudulent or have any unlawful or fraudulent purpose or effect, in any way cause damage to the image of Euroleague Basketball, its participant clubs or players.

 

Videos that do not comply with the requirements will not be deemed eligible. The Organizer reserves the right to reject any entries that are incorrect, incomplete, suspicious or invalid. The Participant agrees not to knowingly damage or cause interruption to the challenge and/or prevent others from entering the challenge.

 

By May 13th, the Organizer will, at its sole discretion, select among all validly submitted videos the best four (4) which will be the finalists and will compete against each other in randomly designated match ups during two (2) rounds (semi-finals and final). In this final phase, the winners of each round will be decided by Instagram users via the Instagram polls we will run on the EuroLeague official Instagram account @euroleague. The video with a higher percentage of votes will qualify for the next round until we have a winner.

 

Participants are required to submit their videos using their EuroLeagueID. Upload of a video using the EuroLeagueID of a registered user shall be understood to have been effected by the said registered user, who shall be responsible in all cases for the uploaded content.

 

 

PRIZES

 

- 1st prize: ELTV Pass for 2020-21 Final Four and for whole 2021-22 season. Possibility to attend an EuroLeague game of his/her choice during the 2021-22 Regular Season to see how a professional broadcast production is done (subject in all cases to attendance to arena being permitted by authorities and in full compliance with health and safety protocols in place). Travel to and from the trip start and end destinations is not included in the prize and must be covered and organised by the prize winner. The prize winner is responsible for obtaining proper travel documentation (e.g., passports), travel insurance, meals not included in selected trip itinerary, ground transportation and all other costs, expenses and taxes. Organizer is not responsible if winner is denied entrance into any country for any reason. No changes are permitted to reservations once game is confirmed or ticket has been issued. Trip must be completed before the end of the 2021-22 Regular Season and is subject to availability at the time of booking. Certain blackout periods may apply.

 

- 2nd prize: ELTV Pass for 2020-21 Final Four and for whole 2021-22 season.

 

- 3rd prize: ELTV Pass for 2020-21 Final Four.

 

The EuroLeagueTV terms and conditions will apply.

 

The winners will be notified in writing by email to the email address available on his/her EuroLeague ID within ten days of the challenge finishing. Winners need to confirm acceptance of the prize within ten working days of receiving the notification email. If the winner cannot be contacted and/or no timely acceptance has been received by Organizer, the winner loses the right to claim the prize; the prize will then be awarded to the next participant with a higher number of votes. Upon notification, if this winner doesn't provide acceptance in writing within ten working days of receiving the notification email, the prize will be cancelled.

 

No cash alternative to the prizes will be offered and no compensation will be given in case that a prize cannot be delivered for whatever reason (including in case that attendance to arena cannot be confirmed as a consequence of a decision by the authorities or applicable protocols). The prizes are not transferable. Prizes are subject to availability and the Organizer reserves the right to substitute any prize with another of similar value without giving notice.

 

All details of the prizes and in particular the terms of their attribution and use will be provided by notification to the winner. No interest will be paid on any prizes. Prize winners may be required, as a condition for redeeming a prize, to sign a publicity release and/or a consent and release for photographs, or any applicable forms requested by authorities or the Organizer. Failure to do so may result in disqualification and forfeiture of the stated prize.

 

All costs, fees and/or expenses incurred or to be incurred by the Winners in relation to the challenge and/or to claim the prize are the sole responsibility of the Winner. 

 

Taxes or legal requirements applicable to the prize shall be responsibility of the Winner.

 

 

TERMS OF USE

 

The terms of use of the Website apply to all users (the “User” and/or “Users”) of the Website, as well as the service rendered through the Website (the “Services”) which is the possibility to upload video content in order to participate in the challenge.

Please read these terms of use carefully before you begin to use the Website or upload any content on the platform. By using the Website and uploading videos, you accept the terms and agree to abide by them.

The Website and uploading platform are provided ‘as is’, and without warranties, representations or undertakings. The Organizer tries to ensure that the Website is accurate at the time of publication, but it does not warrant that this is the case. The Organizer makes no guarantees that the Website and/or the uploading platform are free from so called computer viruses. It is strongly recommended that you check for such viruses before access the Website or its uploading platform.

Nothing on the Website or uploading platform constitutes any part of a contract unless otherwise expressly stated. Any links within the Website to third party websites, if any, are not checked by the Organizer and the Organizer bears no responsibility for the content of external sites. If you access external sites through the Website, you do so at your own risk.

As a way of example and without limitation, the Organizer shall not be liable for any damages that may result from:

Interruptions, viruses, technical problems, interferences, unavailability, failure of the telecommunication networks or the participants equipment which are not the Organizer’s responsibility, delays or unavailability of the Website and the uploading platform due to maintenance or software updates, and or due to deficiencies or traffic overload on the Internet, in the communication network or the electricity grid, and any other event beyond the Organizer’s direct control.


The Organizer accepts no liability for any claims, penalties, loss or expenses arising from your use of the Website or the uploading platform including: any reliance you might place on the Website or uploading platform; use of or inability to use the Website or uploading platform; or any unauthorised use or access to the Website or uploading platform.

 

PRIVACY POLICY

Participation in the challenge requires having a valid EuroLeague ID. When obtaining an EuroLeagueID, you will be providing certain personal data to Euroleague Ventures SA according to its Privacy Policy. All personal information provided will be included in a database property of Euroleague Ventures, S.A with registered address at 60 Grand-rue, L-1660 Luxembourg, and managed by Euroleague Entertainment & Services S.L.U., with registered address at C/ Quatre Camins, 9-13, 08022 Barcelona, Spain. Please review our privacy policy to know more about said collection and processing of your personal data.

The videos you upload will be stored temporarily on the Website until the end of the challenge. After this, the Website will be closed and we will store the videos for a maximum period of six months and for the sole purposes of managing your participation in the challenge (to ensure that you meet the criteria to be a participant and winner, to contact the winners and to deliver the prize), and to use your image in order to  create a video compilation of some of the videos submitted by the participants. No further use of the videos will be made by the Organizer besides what is specified in these Terms. If you qualify for the final phase, your video will be shared on the EuroLeague official Instagram account @euroleague through which we will conduct a poll for the users to decide the winners.  

In addition to the foregoing, the following personal data will be collected from participants accessing and navigating around the Website: IP and location.

You can exercise, at any time, under the terms established by law, your rights of access, rectification or deletion of data, as well as request restrictions on the processing of your personal data, oppose its processing or request the portability of your data, by sending a postal communication to the address indicated above or by writing an e-mail to [email protected]. In any case, you can file a complaint before the competent data protection authority.

 

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Luxembourg and any disputes that may arise will be subject to the jurisdiction of the Luxembourgish courts.
